1. Scope of Application
These General Terms and Conditions apply to all contracts concluded by customers with us, Mime GmbH, Bayerwaldstr. 9, 81737 Munich, Germany, via our online store at www.mimemoi.com.
2. Delivery / Prices / Shipping Costs

In addition to the posted prices, we also charge for shipping for each order as indicated for the respective item.
3. Conclusion of Contract / Contract Language / Correction of Input Errors
The showcasing of the products in the online store does not constitute a legally binding offer but serves as an invitation to bargain (i.e., to submit an offer by placing a binding order). Your order is an offer to buy the product(s) in your order. You express this by placing the desired items in the virtual shopping cart, clicking on the “Proceed to checkout” button, and concluding by clicking on the “Place your order” button, at which time your order is binding. After we have received your order, you will automatically receive an e-mail documenting it. This e-mail only confirms that we have received your order; it does not mean a contract has been concluded.
A legally binding contract does not come about until we either accept your offer (order) by requesting payment upon placement of the order, or send you a declaration of acceptance (confirmation of order) by e-mail, or effect delivery of the merchandise within five days.
All contracts are concluded exclusively in German.
You can correct input errors before placing your order by employing the technical means available to you in the online store and by using your keyboard and mouse. You can abort the process at any time by closing your browser window/tab. By clicking on the “Place your order” button you have placed a binding order; input errors can no longer be corrected.
4. Payment Terms
The following payment options are available:
Payment in advance
You pay in advance by wire transfer within seven (7) days of receiving the request for payment.
You make payment directly via your PayPal account. After placing your order, you are redirected to PayPal and approve the order value.
Credit card (VISA, MasterCard and American Express)
Your credit card is charged when the merchandise you have ordered is shipped.
You make payment directly via your Amazon account. After placing your order, you are redirected to Amazon to approve the order value and complete the payment.
Sofort Überweisung (instant wire transfer)
You effect payment immediately in advance via your online checking account (PIN/TAN) using the payment transaction processing service of Sofort AG.
5. Retention of Title
The merchandise shall remain the exclusive property of Mime GmbH until the purchase price has been paid in full.
6. Cancellation Policy
Right of Cancellation
You have the right to cancel the contract within fourteen (14) days without having to give any reason. The notice of cancellation period is fourteen (14) days from the date on which you or a third party designated by you (but not the parcel service), takes physical possession of the final merchandise item.
To exercise your right of cancellation, you must inform us (Mime GmbH, Bayerwaldstr. 9, 81737 Munich, Germany, phone: 0049 (89) 237 98 808, e-mail: firstname.lastname@example.org) by making an unequivocal statement (e.g., a letter sent by postal mail, telefax or e-mail) concerning your decision to cancel this contract. You can use the sample cancellation form available below; however, this is not mandatory.
To comply with the cancellation notice period, it is sufficient if you send notification of your intention to exercise your right of cancellation before the notice period expires.
Consequences of Cancellation
If you cancel this contract, we are obligated to refund all payments that we have received from you including delivery costs (with the exception of additional costs resulting from your choosing a method of delivery other than the most economical standard delivery offered by us). We are obligated to effect the refund without undue delay and within fourteen (14) days at the latest from the day on which your notice of cancellation of this contract is received by us. For this refund we will employ the same method of payment used by you in the original transaction unless expressly agreed otherwise with you; in no event will you incur any charges for this refund. We may withhold the refund until we have received the merchandise back or you have supplied evidence of having sent the merchandise back, whichever is the earliest.
You must send back the merchandise or hand it over to us without undue delay and in any event no later than fourteen (14) days from the day on which you communicate your cancellation of this contract to us. This deadline is met if you send back the merchandise before the 14-day period has expired.
You will have to assume the direct cost of returning the merchandise.
You are only liable for any diminished value of the merchandise resulting from handling that is not deemed necessary to establish the nature, characteristics and functioning of the merchandise.

8. Saving of the Contract Text
Immediately after you place your order (meaning we receive your offer to conclude a purchase contract for the items ordered by you), we save the contract text and send it to you by e-mail together with our general terms and conditions. If you have set up a customer account in our online store before completing the shopping cart process, you can also access the contract at any time by using your login credentials to access your customer account; this can be done as long as you don’t delete the account or have it deleted by us. You can also make a printout of your order details after placing your order.
9. Complaints / Mediation
The EU Commission provides a web platform for out-of-court dispute resolution. It enables consumers to attempt to resolve disputes relating to orders placed by them online without immediately resorting to court action.
